TERMS AND CONDITIONS FOR PREPAYMENTS FOR SPECIALIST CONSULTATIONS

§ 1. General provisions

These Terms and Conditions for Prepayments hereinafter referred to as the “Terms and Conditions” set out the rules for making prepayments for specialist consultations offered by Neurolocus Centrum Leczenia Bólu Spółka z ograniczoną odpowiedzialnością, with its registered office in Warsaw (04-281), ul. Olszynki Grochowskiej 11/15, unit U3, entered in the register of entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw under KRS number: 0001159800, NIP: 1133160938, REGON: 541092345 hereinafter referred to as the “Service Provider”.

The Terms and Conditions are made available free of charge on the website neurolocus.pl in a form that allows them to be downloaded, saved and printed.

A Patient making a prepayment declares that they have read these Terms and Conditions and accept their provisions in full.

The prepayment constitutes a fee for a specialist consultation within the meaning of Article 394 § 1 of the Civil Code (earnest money), unless these Terms and Conditions provide otherwise.

 

§ 2. Definitions

Patient – a natural person using or intending to use a specialist consultation provided by the Service Provider.

Specialist consultation – a medical appointment with a specialist, including but not limited to a neurologist, orthopaedist, pain medicine specialist or another specialist indicated in the Service Provider’s offer, carried out in person at the Service Provider’s registered office.

Prepayment – a fee amounting to 100% of the price of the specialist consultation, made by the Patient before the appointment date through the Payment Operator, constituting confirmation of the appointment reservation.

Payment Operator – an entity providing online payment services through which the Patient makes the prepayment, including but not limited to Przelewy24, PayU, Stripe or another operator indicated on the Service Provider’s website.

Price List – the current list of prices for specialist consultations, available on the website neurolocus.pl and at the Service Provider’s reception.

 

§ 3. Rules for making prepayments

The condition for reserving a specialist consultation appointment is making a prepayment amounting to 100% of the price of the given consultation in accordance with the current Price List.

The prepayment is made through the online payment system available on the website neurolocus.pl or via a payment link sent to the Patient electronically by e-mail or SMS.

The reservation of the consultation appointment is confirmed when the prepayment is credited to the Payment Operator’s account.

After making the prepayment, the Patient receives confirmation of the reservation electronically by e-mail, including the date, time and type of consultation, as well as information about the payment made.

The prepayment amount is credited towards the price of the specialist consultation. The Patient does not incur any additional fees on the day of the appointment, unless additional services exceeding the scope of the paid consultation are ordered during the consultation.

 

§ 4. Cancelling and rescheduling appointments

The Patient has the right to cancel a reserved specialist consultation. The consequences of cancellation depend on the time at which the cancellation statement is submitted:

    1. Cancellation made more than 24 hours before the scheduled consultation date – the Patient is entitled to a refund of the prepayment amounting to 100% of the amount paid. The refund will be made within 14 business days to the account from which the payment was made.
    2. Cancellation made less than 24 hours before the scheduled consultation date – the Patient is not entitled to a refund of the prepayment. The Service Provider retains 100% of the prepayment amount as compensation for the reserved and unused appointment slot.
    3. Failure of the Patient to attend the appointment without prior cancellation – the Service Provider retains 100% of the prepayment amount.

The Patient has the right to reschedule the consultation free of charge to another available date, provided that the change is reported more than 48 hours before the scheduled date of the original consultation. In such a case, the prepayment is automatically transferred to the new appointment date.

A request to reschedule the appointment made less than 48 hours before the scheduled date is treated as cancellation of the consultation and is subject to the rules set out in section 1 letter b) above.

Cancellation or rescheduling of a consultation may be made by telephone, by e-mail or through the form on the website neurolocus.pl. The date of cancellation or rescheduling is deemed to be the moment when the Service Provider receives the information during the reception desk’s working hours.

 

§ 5. Cancellation of the appointment by the Service Provider

In the event of cancellation of the consultation for reasons attributable to the Service Provider, including the unavailability of a specialist, force majeure or technical failure, the Patient is entitled to:

    1. a refund of the prepayment in full, amounting to 100%, within 14 business days to the account from which the payment was made, or
    2. transfer of the prepayment to another consultation date agreed with the Patient.

The Service Provider informs the Patient of the cancellation of the consultation without delay, by telephone or electronically.

 

§ 6. Force majeure

The Service Provider shall not be liable for non-performance or improper performance of obligations arising from these Terms and Conditions if this is caused by events constituting force majeure, meaning external events that could not be foreseen or prevented, such as natural disasters, states of epidemic or acts of public authorities.

In the event of force majeure preventing the consultation from being carried out, the Patient is entitled to a full refund of the prepayment regardless of the time of cancellation.

 

§ 7. Personal data protection

The Service Provider is the controller of the Patient’s personal data. Personal data are processed for the purpose of carrying out the prepayment service, reserving the specialist consultation and fulfilling legal obligations imposed on the Service Provider, including tax and accounting obligations.

The legal basis for data processing is Article 6(1)(b) and (c) of Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) – processing is necessary for the performance of a contract and for compliance with a legal obligation.

§ 8. Complaints

The Patient has the right to submit a complaint regarding the prepayment or the consultation reservation process.

A complaint may be submitted in writing to the address of the Service Provider’s registered office, electronically to the e-mail address provided on the website neurolocus.pl or by telephone.

The Service Provider reviews the complaint within 14 days from the date of its receipt and informs the Patient of the manner in which it has been considered using the same method by which the complaint was submitted.

§ 9. Final provisions

The Service Provider reserves the right to amend these Terms and Conditions. Amendments enter into force on the date of their publication on the website neurolocus.pl. Amendments to the Terms and Conditions do not apply to prepayments made before the date on which the amendments enter into force.

In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply, in particular the Civil Code, the Act on Consumer Rights of 30 May 2014 and the Act on Medical Activity of 15 April 2011.

Any disputes arising from these Terms and Conditions shall be resolved by the court having local jurisdiction in accordance with the provisions of the Code of Civil Procedure.

A Patient who is a consumer has the right to use out-of-court methods of handling complaints and pursuing claims, including through the ODR (Online Dispute Resolution) platform available at: https://ec.europa.eu/consumers/odr.

These Terms and Conditions enter into force on 1 April 2026
